Services such as roads, sewer, water supplies and recreational facilities have not been able to keep up with the growth.

To provide orderly growth at a rate that would parallel city improvements, the proposed ordinance suggests that 180 permits be issued each year for residential development. The Sanibel Planning Commission would be granted authority to distribute the permits, the proposed law says, with permits to be allocated three times a year or less. The city council would have power of review for planning commission decisions. If an applicant did not begin construction within 60 days of getting a permit, the permit could be taken back. Considerations also should be given to the number of permits allotted any single developer within a year, the proposed law states.

Guidelines to help decide who should get priority on permits also were suggested in the proposed ordinance. Those guidelines include: Conformity with Sanibel's Comprehensive Land Use Plan. Availability of public facilities and services, such as the capacities of the water, sewer, drainage and roads systems to handle the proposed development. Insuring a balance of housing types to include low- and moderate-income housing. A poll of registered Sanibel voters conducted last fall by the Committee Of The Islands showed that residents are concerned with overdevelopment, Mrs. Eskew said. According to the poll, 40 percent said overdevelopment was one of Sanibel's worst problems; 57 per- cent said the city had done a fair or poor job in controlling growth; 57 percent said the growth rate has been too fast, and 64 percent favored an ordinance limiting the number of dwelling units built in a year.

Similar regulatory ordinances have been passed in other cities in Petaluma and Santa Barbara, and Boulder, Mrs. Eskew said, and city officials from those towns had been consulted on the ordinance. Previous Supreme Court rulings have upheld cities' rights to pass such legislation, and Humphrey said the city has the power to pass the law under powers of its charter, the Florida Municipal Home Rule Powers act, and the County and Municipal Planning Act. Sanibel councilmen got their first look at the proposed ordinance Tuesday afternoon but had little -comment on the proposal initially. Mayor Zelda Butler said "there is nothing more important facing this city than this ordinance," and Councilman Porter Goss said he was pleased to hear somebody offering the council a solution instead of a problem.
