NEWS-PRESS, TUESDAY, APRIL 27, 1993 5B LOCAL STATE Slain abortion doctor's son speaking on killing Battle over Band buy goes Lee coy pie's way Judge: County must pay for environmentally sensitive property The Associated Press By PETEWINTON News-Press staff writer apartment. "Donahue" featured a debate between Gunn and Paul Hill, an abortion opponent who rationalized Gunn's slaying by comparing the Eu-faula doctor to Nazi torturer Dr. Joseph Mengele. After that came interviews with CNN, Time, Newsweek, the Today Show and the editorial board of The New York Times. On April 1, Gunn testified before a congressional subcommittee, which later approved a bill that would make it a federal crime to blockade abortion clinics or threaten their personnel.

Gunn is a lifelong rock music fan with shoulder-length hair, a deep Southern accent and hopes of teaching college English. But armed with an "Abortion Busters Manual" published by Operation Rescue of California a publication he refers to as a terrorist manual Gunn says he will make appearances as long as people ask him. BIRMINGHAM The son of an abortion doctor who was gunned down in Florida has since gotten caught up in the debate over abortion, speaking out frequently about his father's slaying. David Gunn Jr. has testified before a congressional panel since the March 10 killing of Dr.

David Gunn, and he will speak at a feminist rally next month in Pensacola, where his father was killed while going to work at an abortion clinic. There have also been numerous media interviews and television interviews for Gunn, a 22-year-old student at the University of Alabama at Birmingham. "Let's see, he was shot on Wednesday, we went to Tennessee that weekend for the memorial service, we got snowed in there, and I went to New York that Monday and I was on the Donahue show," Gunn said recently at his Shelby County court sent the case back to Swartz, saying his ruling was made without a sufficient factual or legal basis. But in a new opinion Thursday, Swartz reaffirmed his prior ruling. Assistant Lee County Attorney John Renner said Monday a new jury trial will be held to set the amount the county should pay the Reahards.

Renner said the county can't appeal Swartz's decision until after that trial is complete. Other counties and the state attorney general's office joined Lee in the initial appeal, fearing the Reahard decision would force cash-strapped local governments to abandon environmental protection rather than risk bankrupting the public coffers to buy environmentally sensitive land. adopted its comprehensive plan in 1984. The Reahard family has owned the land since 1944. Under the comprehensive plan, development on wetlands is limited to one home every 40 acres.

The Reahards argued that the county by its development restrictions had essentially taken their property without paying for it. The Reahards said their plans to develop the property were shattered when the county adopted the comprehensive plan. U.S. Magistrate George Swartz agreed, and in May 1991 a jury awarded the Reahards $700,000 the amount the county would have had to pay for the property. In August, a federal appeals ii in nitfV In a battle that goes to the core of environmental protection laws, a federal magistrate has ruled that Lee County must pay a Bonita Springs couple for land the county considers environmentally sensitive.

The dispute centers on whether the county's comprehensive plan its blueprint for land use and growth deprived Richard and Ann Reahard of the right to develop their land. The Reahards own 40 acres of wetlands near Bonita Beach, on which they had planned to build 126 homes until the county The Associated Press FATHER KILLED: David Gunn whose father, Dr. David Gunn, was fatally shot March 10 outside a Pensacola abortion clinic, wants a federal law to protect abortion clinics.
